La loi Naegelen, du <\/span><\/span>d\u00e9put\u00e9 <\/span><\/span>de la 3\u00e8me circonscription des Vosges visant \u00e0 encadrer le d\u00e9marchage t\u00e9l\u00e9phonique et \u00e0 lutter contre les appels frauduleux, a \u00e9t\u00e9 publi\u00e9e au Journal Officiel du samedi 25 juillet dernier. Les <\/span><\/span>premi\u00e8res mises en application<\/span><\/span> viennent d\u2019avoir lieu.<\/span><\/span><\/strong><\/span><\/h2>\n

Ainsi, la soci\u00e9t\u00e9 SAS RENOV France a \u00e9t\u00e9 sanctionn\u00e9e, notamment, sur le fondement du code de la consommation pour d\u00e9marchage t\u00e9l\u00e9phonique abusif de consommateurs inscrits sur la liste d’opposition Bloctel et ne souhaitant pas faire l\u2019objet d\u2019une prospection commerciale.<\/span><\/span><\/span><\/p>\n

Sanction administrative d’un montant de 33 600 euros \u00e0 l\u2019encontre de la SAS RENOV FRANCE – 03\/12\/2020<\/span><\/span><\/span><\/i><\/p>\n

La Direction d\u00e9partementale de la protection des populations du Val-de-Marne a prononc\u00e9 une amende administrative d\u2019un montant de 33 600 euros \u00e0 l\u2019encontre de la SAS RENOV FRANCE pour manquements aux articles L. 221-5 (d\u00e9faut d\u2019information pr\u00e9contractuelle dans le cadre d\u2019un contrat conclu hors \u00e9tablissement commercial), L. 221-8 (d\u00e9faut d\u2019information contractuelle dans le cadre d\u2019un contrat conclu hors \u00e9tablissement commercial), L. 221-25 (ex\u00e9cution d’une prestation de services ou d’un contrat avant la fin du d\u00e9lai de r\u00e9tractation), L. 223-1 (d\u00e9marchage t\u00e9l\u00e9phonique de consommateurs inscrits sur la liste d’opposition au d\u00e9marchage t\u00e9l\u00e9phonique et ne souhaitant pas faire l\u2019objet d\u2019une prospection commerciale) et L. 616-1 du code de la consommation (absence de communication au consommateur des coordonn\u00e9es du ou des m\u00e9diateurs comp\u00e9tents dont rel\u00e8ve le professionnel).<\/span><\/span><\/span><\/i><\/p>\n
